These Terms and Conditions of Use govern your access to and use of websites, mobile experiences, and other online services operated by big Burrito Restaurant Group and its operating divisions and affiliates (collectively, "big Burrito," "we," "us," or "our"). We refer to them together as the "Services."
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. Additional terms may apply to a particular transaction, promotion, reservation, order, gift card, or third-party service. If those additional terms conflict with these Terms, the additional terms control for that specific matter.
The Services include websites and online experiences that big Burrito operates for its restaurant concepts, catering and events, gift cards, customer communications, and related offerings. We may add, remove, or change a website, feature, restaurant concept, or service without updating a fixed list of domain names in these Terms.
You may use the Services only if you can form a binding contract under applicable law. If you are under 18, you may use the Services only with the involvement and permission of a parent or legal guardian. You must be of legal drinking age and present valid identification when required to purchase, receive, or consume alcoholic beverages.
Our Privacy Policy describes how we collect, use, and disclose personal information. By using the Services, you acknowledge that you have reviewed the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Services for lawful personal purposes in accordance with these Terms.
You may not:
• use the Services in violation of any applicable law or the rights of another person;
• interfere with the operation or security of the Services, attempt to gain unauthorized access, or introduce malicious code;
• use automated tools to access, scrape, copy, monitor, or extract content from the Services except as permitted by law or with our prior written permission;
• impersonate another person, submit false information, or engage in fraudulent activity;
• copy, modify, distribute, sell, license, publicly display, or create derivative works from Service content except as expressly permitted by us or by applicable law; or
• remove or alter copyright, trademark, or other proprietary notices.
We may suspend or terminate access to the Services when we reasonably believe a user has violated these Terms, created a security risk, or used the Services unlawfully.
The Services and their content, including text, menus, photographs, graphics, logos, trademarks, trade dress, designs, software, and other materials, are owned by or licensed to big Burrito and are protected by intellectual property laws. Except for the limited right to use the Services granted above, no right, title, or interest is transferred to you.
Names, logos, and other marks displayed through the Services may not be used without the prior written permission of their respective owners.
If you submit a review, photograph, comment, suggestion, or other content through the Services, you represent that you have the right to submit it and that it does not violate any law or third-party right. You grant big Burrito a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content as reasonably necessary to operate, promote, and improve our business and Services, subject to our Privacy Policy.
We may use ideas, suggestions, or feedback you voluntarily provide without compensation or obligation to you. Do not submit confidential business information through general feedback or contact forms.
Orders, reservations, gift card purchases, catering inquiries, event bookings, loyalty programs, and promotions may be processed by big Burrito or by third-party providers. Additional terms, fees, cancellation rules, refund rules, expiration terms, eligibility requirements, and other conditions may be presented when you complete a transaction or participate in an offer. Those transaction-specific terms are part of your agreement.
Submitting an order or request does not guarantee acceptance. We may reject or cancel a transaction when an item is unavailable, information is inaccurate, payment cannot be processed, fraud is suspected, or fulfillment is not reasonably possible. If we cancel a paid transaction, any refund due will be handled according to the applicable transaction terms and law.
Menu items, ingredients, prices, hours, availability, photographs, descriptions, and nutrition or dietary information may change and may differ by restaurant or ordering channel. Taxes, service charges, delivery charges, and other fees may apply and will be disclosed as required during the transaction.
If you have a food allergy or dietary restriction, contact the restaurant directly before ordering. Unless expressly stated otherwise, we do not represent that any menu item is free of a particular allergen or that cross-contact cannot occur. Information provided through the Services is general information and is not medical advice.
The Services may link to or integrate with third-party websites, applications, reservation systems, delivery services, payment processors, gift card providers, social media platforms, and other services. Third parties operate under their own terms and privacy practices. A link or integration does not mean that big Burrito controls or endorses the third party, and we are not responsible for third-party content, availability, security, or practices.
We may modify, suspend, or discontinue all or part of the Services. We do not guarantee that the Services will always be available, secure, uninterrupted, or error-free. You are responsible for maintaining the security of your devices and any account credentials you use with the Services.
We are committed to making our digital services accessible. If you have difficulty accessing content or completing a transaction, contact us using the information below so we can provide assistance or an alternative method when reasonably available.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND THEIR CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." BIG BURRITO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES OR THEIR CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, AVAILABLE, SECURE, OR FREE OF ERRORS OR HARMFUL COMPONENTS.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you. Nothing in these Terms excludes rights that cannot lawfully be excluded.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIG BURRITO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIG BURRITO'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO BIG BURRITO THROUGH THE SERVICES FOR THE TRANSACTION GIVING RISE TO THE CLAIM OR ONE HUNDRED DOLLARS. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Unless applicable law requires otherwise, any legal action arising from or relating to these Terms or the Services must be brought in a state or federal court located in Allegheny County, Pennsylvania, and you consent to the jurisdiction of those courts.
14 Changes to These Terms
We may update these Terms from time to time. The date at the top shows when they were last updated. Changes become effective when posted unless a later date is stated or applicable law requires another form of notice. Your continued use of the Services after the effective date of revised Terms means you accept the revised Terms. Changes will not apply retroactively to a dispute that arose before the changes were posted unless permitted by law and expressly stated.
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the greatest extent permitted by law. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any applicable transaction-specific terms, constitute the entire agreement between you and big Burrito concerning the Services.
